Summer Program Liability Waiver

RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT HTC Global Scholars — Summer Intensive: Sustainable Living Program Operated by Healthy Toddlers Care, San Diego, CA READ CAREFULLY BEFORE SIGNING. THIS IS A RELEASE OF LIABILITY. By signing this agreement, you acknowledge and agree to all terms below on behalf of yourself and/or your minor child ("Participant"). 1. DESCRIPTION OF ACTIVITIES The HTC Summer Intensive: Sustainable Living program ("Program") includes, but is not limited to: outdoor gardening and planting, handling of soil, fertilizers, and compost; use of garden tools (shovels, shears, trowels); harvesting and handling of produce; exposure to plants, pollen, and insects; food preservation activities including water-bath canning and food dehydration; poultry/livestock care including direct contact with live chickens, eggs, and animal waste; greenhouse operations; outdoor physical activity in San Diego Zone 10b heat conditions; and any other activities associated with sustainable agricultural education. 2. ASSUMPTION OF RISK Participant and Parent/Guardian voluntarily assume ALL RISKS associated with the Program, whether or not such risks are known at the time of registration, including but not limited to: cuts, scrapes, or puncture wounds from tools or plants; allergic reactions to plants, insects, pollen, or food items; exposure to animal dander, feathers, or waste; slipping, tripping, or falling on uneven outdoor surfaces; heat-related illness or sunburn during outdoor activities; minor injuries during food preparation or preservation labs; transmission of communicable illness in a group setting. 3. RELEASE OF LIABILITY In consideration of being permitted to participate in the Program, Participant and Parent/Guardian hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Healthy Toddlers Care, HTC Global Scholars, its owners, directors, employees, volunteers, and agents (collectively "Released Parties") from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, injury, or death that may be sustained by the Participant while participating in the Program, whether caused by the negligence of the Released Parties or otherwise, to the fullest extent permitted by California law. 4. INDEMNITY AGREEMENT Participant and Parent/Guardian agree to INDEMNIFY AND HOLD HARMLESS the Released Parties from any loss, liability, damage, or cost they may incur due to the participation of the Participant in the Program, whether caused by negligence or otherwise. 5. MEDICAL AUTHORIZATION In the event of injury or illness requiring immediate medical attention, Parent/Guardian authorizes Released Parties to seek emergency medical treatment for the Participant at the Parent/Guardian's expense. Released Parties will make reasonable efforts to contact the Parent/Guardian immediately. 6. PHOTO & MEDIA RELEASE (Optional) Parent/Guardian may grant HTC Global Scholars permission to photograph and/or video record the Participant during program activities and to use such media for educational and promotional purposes including website, social media, and marketing materials. This is optional and indicated separately below. 7. HEALTH & SAFETY COMPLIANCE Participant agrees to: follow all instructor safety directions; wear appropriate closed-toe footwear at all times; disclose any allergies, medical conditions, or medications to program staff; comply with the Wash-Work-Wash sanitation protocol; and respect all tools, animals, and garden materials. 8. PROGRAM RULES ACKNOWLEDGMENT Participant and Parent/Guardian acknowledge that failure to follow program rules and instructor directions may result in removal from the program without refund. 9. GOVERNING LAW This agreement shall be governed by the laws of the State of California. If any portion of this agreement is found unenforceable, the remaining provisions shall remain in full effect. 10. ACKNOWLEDGMENT By signing below, Parent/Guardian confirms they have read this entire agreement, understand its contents, agree to be bound by its terms, and acknowledge they are the legal parent or guardian of the Participant and have the authority to execute this agreement on the Participant's behalf.
